Xxtra Research Pty Ltd ABN 19 125 415 385 operates Airtime Surveys, an online community and surveys platform, from within Australia. Xxtra Research Pty Ltd from here on in will be referred to as our business name, Xtra Insights.
These General Contest Rules apply to all Xtra Insights contests. They may be amended or varied from time to time by Xtra Insights. Special Terms and Conditions may apply to particular contests, in which case an addendum to these General Contest Rules will be made for that contest. Please enquire at Xtra Insights for any special Terms and Conditions for contests you wish to enter.
- Unless otherwise specified in special contest Terms and Conditions, no person may enter any contest more than once.
- All prizes will be delivered within 6 weeks from the date of winning. Unclaimed prizes will be dealt with according to legislative requirements. Xtra Insights will not notify winners of time remaining. It is the sole responsibility of winners to collect their prize.
- Depending on the competition prizes may be;
- mailed to winners at the address provided with member's registration details. No responsibility will be accepted by Xtra Insights for the safe and effective postal delivery of the prize, please refer to Terms and Conditions.
- emailed to winners designated email address as provided in the registration form or a confirmation email.
- electronic deposit transfer of funds as described in the competition terms.
- In special situations, and subject to the absolute discretion of Xtra Insights, a winner may nominate a designated representative to receive a prize. The representative will be required to present written authorisation from the winner.
- In the event that a winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of Xtra Insights subject to legislative requirements.
- A copy of these General Contest Rules must be signed and endorsed by any winner upon request by Xtra Insights.
- Prizes are non-transferable, must (where applicable) be used on the dates specified and may not be redeemed for cash.
- All prizes are accepted entirely at the risk of the winner, and Xtra Insights excludes all warranties in connection with any prize to the extent permitted by law.
- Xtra Insights, its agencies, affiliates, sponsors and representatives are not responsible for defective prizes or misuse of any prize, or for any claims, liability, loss or damage arising out of or in connection with any contest promoted by Xtra Insights.
- All participants release from, and indemnify Xtra Insights against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in any contest including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
- If a specified prize becomes unavailable, Xtra Insights may, subject to State regulation, substitute a replacement prize at its absolute discretion.
- Unless otherwise specified, the class of travel for any travel prize incorporating an airfare is economy class.
- Participants acknowledge and agree that all information provided by a participant to Xtra Insights will be processed in accordance with the terms of the Privacy Policy. To the extent that a term of these contest rules is inconsistent with the Privacy Policy, the term in the Privacy Policy will prevail.
- Participants may be requested by Xtra Insights to participate in a photo, video and/or film session and acknowledge that Xtra Insights will use such publicity photos, videos and/or films in any medium and in any reasonable manner it sees fit, only after the participant has given Xtra Insights full consent at the time of entering the relevant contest.
- Participants expressly acknowledge and agree that contest entries and material submitted in connection with any contest (whether in written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants become the property of Xtra Insights which may use the material in any medium and in any reasonable manner it sees fit, unless this is a breach of the Privacy Policy. Copyright in any such material becomes and remains the sole property of Xtra Insights.
- Participants expressly acknowledge and agree that Xtra Insights may publicise, broadcast or otherwise disclose a winners first name, statements or any recording of their voice in advertising or promotional activities concerning a specific contest, unless this is a breach of the Privacy Policy.
- Winners are responsible for any and all taxes payable as a result of a prize being awarded or received.
- All entries by internet are sent entirely at the risk of the entrant. If there are any difficulties arising out of the internet or any associated equipment Xtra Insights may at its absolute discretion disqualify the entire entry or any portion thereof.
- Participants expressly acknowledge and agree that Xtra Insights may incorporate information from entrants in any contests in any data base to be used for the purpose of its business.
- Where Xtra Insights has special Contest Terms and Conditions in relation to a particular contest, then they will prevail to the extent of any inconsistency between those special Contest Terms and Conditions and these General Contest Rules.
- A failure by Xtra Insights to enforce any of these General Contest Rules in any instance(s) will not give rise to any claim by any person.
- Xtra Insights may, subject to State regulation, terminate any contest at any time at its absolute discretion. In the event of such termination, Xtra Insights may at its absolute discretion elect not to award any prize in respect of the terminated contest. Special restrictions or qualifications may apply to particular contests, in which case an addendum to these General Contest Rules will be made. These General Contest Rules may, subject to State regulation, be changed at any time by Xtra Insights.
